1. Acceptance of Terms
By creating an account or using the Hitaji 360 platform (the “Service”), operated by Hitaji Technologies Ltd (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Hitaji 360 is a cloud-based business management platform that provides tools for task management, team collaboration, communication, human resources, accounting, customer relationship management, and other business operations. The Service is provided on a subscription basis, with certain features available under free and paid plans.
3. Account Registration
To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Upload or transmit viruses, malware, or other harmful code
- Attempt to gain unauthorised access to the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to store or transmit content that infringes third-party intellectual property rights
- Resell, sublicense, or share your account credentials with unauthorised parties
5. Data Ownership
You retain all ownership rights to the data you upload, create, or store through the Service (“Your Data”). We do not claim ownership of Your Data. You grant us a limited licence to host, store, and process Your Data solely for the purpose of providing the Service to you.
6. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control.
7. Payment Terms
Paid subscriptions are billed in advance on a recurring basis (monthly or annually) as selected at the time of purchase. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' advance notice. Failure to pay may result in suspension or termination of your account.
8. Intellectual Property
The Service, including its software, design, logos, and documentation, is owned by Hitaji Technologies Ltd and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.
9. Termination
You may terminate your account at any time by contacting our support team. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will make Your Data available for export for a reasonable period (30 days) after termination.
10. Limitation of Liability
To the maximum extent permitted by law, Hitaji Technologies Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Hitaji Technologies Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Uganda, without regard to its conflict of law provisions.
